Government of Pakistan, Finance Division was issued a Notification (By the approval of Prime Minister’s Secretariat’s U.O.No.708/PSPM/2013, dated 05-03-2013) of Special Allowance 20% of running basic pay with effect from 1st March, 2013 to the all officers and staff working in the Federal Ministries/Divisions only. This allowance is not allowed to the employees of President’s Secretariat, Prime Minister’s Secretariat, Wafaqi Mohtasib’s Secretariat, Federal Tax Ombudsman’s Secretariat, National Assembly Secretariat and Senate Secretariat, and all such other entities who are already being paid any additional allowances and other facilities.
The amount of the Special Allowance,
i) Will be admissible to contingent paid staff and contract employees employed against civil posts in Basic Pay Scale on standard terms and conditions of contract appointment.
ii) Will be admissible during leave and entire period of LPR except during extra ordinary leave.
iii) Will not be treated as part of emoluments for the purpose of calculation of Pension/gratuity and recovery of House Rent.
iv) Will not be admissible to the employees during the tenure of their posting/deputation abroad.
v) Will be admissible to the employees on their repatriation from posting/deputation abroad at the rate and amount which would have been admissible to them had they not be posted abroad.

Through this single short order, for the reasons to be recorded later on, Writ Petition Nos.996, 1073, 1102, 1104, 1107, 1109, 1110,1262, 1315, 1320, 1502, 1513, 1531, 1782, 1872, 2010, 2364, 2365, 2366, 2469, 2557 and 2571 of 2013 are being disposed of.
2. Petitioner invoked the constitutional jurisdiction of this court by way of filing instant writ petition with the following prayer:-
“It is therefore, respectfully prayed that in view of the above mentioned circumstances/facts, this Hon’ble Court may graciously be pleased to declare and pass and order as under:-
a) The petitioners along with other employees of Department of Communications Security, Cabinet Division Pak Sectt. Islamabad are entitled and eligible for the same all benefits i.e salary, facility, allowance, special allowance and retiring benefits etc. which are already extended to the employees of other neighbouring departments in similar pay scale.
b) To pass an order whereby directing to the respondents to pay the 20% special allowance
w.e.f March, 2013 to the petitioners and other employees of the department of Communication Security, Cabinet Division, Islamabad.
c) To grant any other equitable relief (s) which this Honourable Court may fit in the special circumstances of the case.
Any other relief which this honourable court may deem fit proper be also granted.”
After going through the pleadings of the parties and hearing the learned counsels, all the above mentioned writ petitions are allowed to the following effect:-
“The grant of special allowance @ 20% to the employees working in the Federal Ministries/Divisions and withholding of same from Federal Government employees of other Secretariats, Departments, and Statutory Bodies where Government Scales are applicable is discriminatory in nature as such offensive to the constitutionally guaranteed rights of those employees. All the Federal Government Employees are, therefore, held entitled to Special Allowance @ 20% w.e.f the date the employees

The Islamabad High Court on Wednesday directed the Finance Ministry to issue the notification with regard to increase in the special allowance of 20% on running basic pay of all the federal government employees by September 30. The court also directed the official of the ministry to submit the copy of the notification before it in next date of hearing as it was granted to the officials of the ministries and divisions. A single member bench of the IHC comprising Justice Shaukat Aziz Siddiqui issued the directives after hearing the contempt petition filed by the federal employees of various departments, seeking the implementation of the court orders regarding raise of 20 percent in the basic salaries as being availed by the ministries’ employees.
During the course of hearing , counsel for petitioner apprised the bench that finance ministry was not implementing the court orders and notification of increase in salaries has not issued so far.
He prayed the court to direct the finance ministry to issue notification of increase in salaries in the light of the court direction.
Nadeem Arshad, an official of the ministry informed the bench that the increment in salaries would cost a huge financial burden on the public exchequer.
To this, justice remarked that every one has to implement the court orders and directed the official of ministry to submit the notification till September 30.
Nadeem argued that the federation has filed an intra court appeal against the decision and sought time dill the decision of the case.
The Judge remarked that there was no stay order issued in result of ICA,so finance ministry should implement the orders of the court in letter and spirit.
Justice Siddiqui observed that all government employees should be equally treated and discriminatory attitude would not be tolerated.
The court had ordered on June 18 for 20 percent increase in the basic pay of the federal employees and had directed the federation to grant the raise in salary with effect from 1st March 2013.
After hearing the arguments, the bench admitted the petitions and adjourned the matter for indefinite period.

The Finance Secretary has cleared the summary of the 20% Special Relief Allowance for all the Federal Govt Employees. This 20% Special Relief Allowance was granted to the Federal Employees of Ministries & Divisions only and the Attached Department’s Employees were left out. Now it will be great news for the Attached Department’s Employees if the Notification of the same is issued soon. It is expected that the Notification of 20% Special Relief Allowance will be issued within few days as the Secretary Finance has promised in the court.

Islamabad High Court has direct the FD to decide the longstanding case and to submit the Notification of 20% Special Allowance within two weeks. The Attorney General requested the Court for some more period. The Islamabad High Court directed the AG let it decided within two weeks, otherwise the Court will decide all ICAs on merit.

Before Justice Athar Minallah & Justice Aamer Farooq in Court#4, Islamabad High Court. Mr. Nadeem Arshad S O (Regulation) Finance Division appeared before the Hon’ble DB and requested that Finance Division could not prepare report on Attached Departments due to busy in preparation in budget, therefore 2 weeks more time was requested by him which was accorded by the Court. “Case adjourned. GRANT OF 20% SPECIAL ALLOWANCE TO CDA EMPLOYEES
The said allowance has already been granted has already been/being granted with effect from 21st January 2015 onward. Hence arrears will be payable with effect from 01-03-2013 to 20-01-2015 to all the employees alongwith pay (one time lump sum)in the next financial year 2015-16.; provision to this effect will have to be made by the DFA-I’s Office in budget estimates for next financial year.
The said benefit will take effect from 01-03-2013 onward applicable to all CDA regular/regular “P” employees and those employed on contract basis against civilian pay scales.
